Jesse McCartney wants everyone to know … if you publish a nude photo of him – even one that looks like him – he’ll sue you.

It seems a photo is floating around … showing what looks like a naked McCartney all by his lonesome.

McCartney’s lawyer, Shawn Chapman Holley, has fired off a cease and desist letter to any web site that would dare publish the photo.

Holley warns, “a person is attempting to circulate a nude photo which purports to be Mr. McCartney.” She goes on, “McCartney was unaware of the taking of this alleged photo, did not knowingly participate in the taking of this photo, and certainly did not consent to the taking of such photo.”

Holley says in the letter, “it appears that this photo has been manipulated and doctored by computer software.”

Holley says the publication of the photo “would be a grave invasion of Mr. McCartney’s privacy rights” and she’ll go after anyone who publishes it for “substantial monetary damages.”

Los Angeles, California (CNN) — Jesse McCartney was only 11 when he scored the role of Adam Chandler Jr. on “All My Children.” Since then, his life has been anything but a soap opera — just a steady stream of acting gigs and a growing career as a singer-songwriter.

At 22, he’s eager to make that leap from child star (and teen favorite) to all-around entertainer. McCartney is currently on the big screen — or at least his voice is — as Theodore, the youngest animated sibling in “Alvin and the Chipmunks: The Squeakquel.” He’s also moving his music in a more R&B direction.

We dropped in on the New York native during a recording session at Fox Studios in Los Angeles. The following is an edited version of the interview.

Jesse McCartney is another celebrity who grew up watching the Chipmunks in his house, but he’s not the only member of the family that was a fan.

McCartney says his parents were avid viewers of the cartoon show – and none of them could ever have predicted he’d be supplying the voice of Theodore for the animated Alvin and the Chipmunks feature and sequel.

Alvin and the Chipmunks: The Squeakquel opened December 23rd, 2009 and raked in $50.2 million its first weekend. It is still going strong with holiday moviegoers and took in a big, fat Friday payday of $13 mil.
